Miss Uzoma Okere, the young woman assaulted by aids to a naval officer in Nigeria Rear Admiral Harry Arogundade in Lagos some weeks back,has prayed court ordered the Senior naval officer to pay her N100 million naira has damages.
In her case filed against Arogundade, the Nigerian navy and Naval ratings, at the Lagos High Court, Okere through her lawyer, Abdulazeez Abdulahi urged the court to compel the respondents to issue unreserved apologies to them for the violation of their fundamental human rights in at least, four print and electronic media and also pay the sum as damages.
The plaintiffs are also seeking an order of perpetual injunction restraining the respondents and their agents from horsewhipping motorists and putting them in apprehension through reckless driving in siren blaring convoy.
Presiding over the case on Wednesday, Justice Opeyemi Oke said the hearing would be on 23rd of February, 2009.
Mainwhile Arogundade and the NN has filed a preliminary objection, challenging the jurisdiction of the court to hear the suit,counsel to the defendants, Mr Lawrence Imolode from the chambers of Bolaji Ayorinde (SAN), told the court yesterday that it lacked the competence to hear the suit and urged it to strike out the matter.
In the preliminary objection by Arogundade and the NN, claimed that the plaintiffs did not seek the leave of the court for the hearing of the originating summons dated November 14.
The defendants further claimed that the NN was not served with the originating summons at its headquarters at Plot 1092, Mohammed Buhari Way, Area 7, Garki, Abuja.
